BER Certificates for Landlords 2026

No BER, no ad — that's the law, and the fine is up to €5,000. Every rental property in Ireland must have a valid BER certificate before you can advertise it. Here's what you need to know about your obligations, the grants and tax relief available, and how to stay compliant in 2026.

What Are the Current Legal Requirements?

Every property offered for rent in Ireland must have a valid BER certificate. The BER rating must be included in all rental advertisements including listings on Daft.ie, property websites, and any other marketing materials. The BER certificate must be provided to prospective tenants. Failure to have a valid BER when advertising a rental property can result in fines of up to €5,000.

If your rental property is a converted house with multiple units (common in areas like Rathmines, Drumcondra and Phibsborough), each individual unit needs its own BER certificate. You can't use a single whole-house BER for multiple flats.

BER Obligations When Changing Tenants

If your existing BER certificate is still within its 10-year validity period and you haven't made material changes to the property, you can use the same cert for a new letting. However, if the cert has expired or you've upgraded the property (new heating system, insulation, windows, etc.), you'll need a fresh assessment. Smart landlords get a new BER after upgrades to show improved ratings, this can justify higher rents and attract better tenants.

Are Minimum BER Standards Coming for Rentals?

The Irish government has been moving toward introducing minimum BER standards for rental properties. Under proposals that have been under discussion, landlords may eventually be required to bring rental properties up to a minimum BER rating (potentially B2 or C1) by a specified deadline. While the exact requirements and timeline continue to evolve, the message is clear — poorly performing rental properties will face increasing regulatory pressure.

This is why we strongly advise landlords to assess their properties now and begin planning upgrades. Properties with very poor ratings (E, F, or G) are most at risk of falling below whatever minimum standard is eventually set. Getting ahead of the regulations means you can plan upgrades on your own timeline, take advantage of current SEAI grants, and avoid a last-minute rush when deadlines approach.

SEAI Grants for Landlords

Landlords are eligible for the same SEAI home energy grants as owner-occupiers, including grants for attic insulation (up to €2,000), cavity wall insulation (up to €1,700), external wall insulation (up to €8,000), heat pump systems (up to €12,500), windows and doors (up to €4,000), and solar PV (€1,800). All SEAI grants require a before-works and after-works BER assessment — we handle both.

Landlord Tax Relief for Retrofit (2026)

In addition to SEAI grants, landlords can deduct up to €10,000 (net of any SEAI grant received) from their rental income for retrofit works. From 2026, this relief applies to up to three properties (increased from two), covering works carried out between 2026 and 2028. Combined with SEAI grants, this means landlords can substantially offset the cost of bringing rental properties up to standard.
