Every new home in Ireland must have a BER certificate before it's first occupied, whether it's being sold or not. Here's how the new build BER process works for developers, self-builders, and contractors.
BER Requirements for New Builds
All new dwellings where planning permission was applied for after 1 January 2007 must have a BER certificate. This applies to developer-built estates, one-off self-builds, apartment blocks, duplexes, and any other new residential construction. The BER must be obtained before the building is first occupied.
New build BER assessments also serve as part of the Building Regulations Part L compliance process. The assessment verifies that the as-built dwelling meets the energy performance requirements set out in the building regulations. This makes the new build BER more technically demanding than an existing dwelling assessment.
Provisional vs Final BER
The new build process typically involves two stages. A provisional BER is based on the design drawings and specifications before construction begins. It's valid for 2 years and is often used for marketing and sales purposes during construction. The final BER (sometimes called the "as-built" BER) is completed after construction and is based on an actual survey of the finished dwelling. This is the definitive certificate that goes on the SEAI register and is valid for up to 10 years.
The final BER should reflect what was actually built, which may differ from the original design. If construction specifications changed during the build (different insulation thickness, alternative heating system, etc.), the final BER will capture these differences.
What Documentation Is Needed?
New build BER assessments require significantly more documentation than existing dwelling assessments. You'll need architectural drawings and specifications, wall, roof and floor construction details including insulation specifications, heating system specifications and commissioning certificates, ventilation system details and air permeability test results, window and door specifications with U-values, and any renewable energy system details (solar PV, solar thermal, etc.).
